MEDIA COURTHOUSE — A Philadelphia man who allegedly ran over and killed a 6-year-old girl while intoxicated March 1 waived formal arraignment on homicide and related charges Wednesday, according to online court records.

Darin Forrest, 53, of the 4600 block of Hawthorne Street, is charged with one count each of homicide by vehicle and homicide by vehicle while DUI, both felonies, as well as a misdemeanor count of involuntary manslaughter, two misdemeanor counts of driving under the influence of alcohol or a controlled substance, a felony count of firearms not to be carried without a license and five summary traffic offenses.

According to an affidavit of probable cause for his arrest, Forrest was trying to back his 2012 Lincoln Navigator into a spot in front of Rudy’s Tavern in the 7100 block of Marshall Road when he ran over Jennifer Portillo as she was crossing the street with her family.

Authorities said Forrest had been drinking at Rudy’s that day before heading to the Waterford Inn on the 6800 block of Ludlow Street for more drinks. He was returning to Rudy's just after 3:00 p.m. when the accident occurred. A toxicology report allegedly pegged Forrest’s blood alcohol content at .106, over the legal limit of .08 BAC.

Forrest was reversing 122 to 143 feet away from the open space around a slight curve and was traveling at a speed between 15.9 and 22.6 mph when he struck Portillo, according to the affidavit. The girl was transported to Delaware County Memorial Hospital, where she was pronounced dead at 3:25 p.m.

Forrest posted 10 percent of $100,000 bail May 24, according to online court records. No pretrial conference hearing date was listed online as of Thursday. Assistant District Attorney Sandra Urban is prosecuting. Forrest is represented by defense attorney Joseph Silvestro.
