MEDIA COURTHOUSE — A 74-year-old Havertown man was placed in the Accelerated Rehabilitative Disposition program this week for an alleged masturbating incident that took place at the YMCA on North Eagle Road in December.
Yang Lee, of Jacalyn Drive, was charged with indecent exposure, open lewdness and disorderly conduct in the Dec. 15 incident.
According to an affidavit of probable cause, Havertford Officer Colin Patrick was dispatched to the YMCA at 5:20 p.m. for a report of an indecent act that just occurred. Delaware County Emergency Services reported that an Asian male was masturbating in the coed sauna.
YMCA employee Paul Hackett allegedly told the officer he was working the 4-7 p.m. supervisory shift and was on the computer when a member approached him and said another member, later identified as Lee, was behaving inappropriately in the sauna.
Hackett said he immediately went into the sauna and “caught Mr. Yang Lee masturbating while he was sitting on the top sauna bench,” according to the affidavit.
Hackett said he approached Lee and explained to him that what he was doing was not appropriate. Lee was arrested and later released on unsecured bail of $20,000.
Under the ARD proposal offered by Assistant District Attorney Brian Doherty and defense counsel Edward J. Schwabenland, Lee will serve 12 months of probation and undergo a psychosexual evaluation.
He was also required to pay $300 toward the program Tuesday and pay for all costs within 90 days, otherwise the ARD will be revoked. Lee was also ordered to stay away from all YMCAs and perform 16 hours of “light duty” community service, due to his age and health.
Lee is suffering from a pituitary tumor, according to Schwabenland. Delaware County Common Pleas Court Judge James Bradley said he may return after six months to ask for a shorter term.
